Sound Services & Equipment Use Agreement

The booking form creates an event-specific version of these terms with the Client, date, venue, selected service, service window, and electronic signature. Booking and payment terms control the payment amount, cancellation review, and the service-readiness or equipment-dispatch requirement that applies to the selected plan.

1. Service and Role

BlackFist Sound provides only the sound service and equipment itemized in the confirmed quote. A Venue Playlist + Engineer plan uses the Client's or venue's verified complete sound system and includes no BlackFist PA columns, wireless microphones, equipment setup fee, or equipment security deposit. It includes on-site sound engineering and curated or Client-approved playlist operation; active DJ performance, live beatmatching, MC work, and live song-request management are excluded unless a revised quote adds them. Equipment-backed and DJ plans include only their separately itemized scope. BlackFist is an independent contractor and retains control of technical methods, safe operation, and artistic choices associated with an approved DJ service. These terms create no employment, agency, partnership, or exclusivity relationship.

2. Client Authority, Venue, and Access

The Client represents that the signer is at least eighteen years old and authorized to approve these terms for the event and venue. The Client obtains venue permission, provides an on-site venue contact, and discloses stairs, elevators, parking, loading, and access limits. Equipment-backed plans require clear access at least ninety minutes before the service window and at least thirty minutes afterward for breakdown and load-out. A Venue Playlist + Engineer plan requires access to the venue system and an authorized venue technician or contact at least forty-five minutes before service. The calendar may reserve additional travel and operational time outside the customer-facing service window.

3. Safe Site, Weather, and Power

The Client provides a flat, stable, dry equipment area clear of unreasonable foot traffic. Outdoor or mixed events require effective overhead weather protection and a dry operating area before setup. BlackFist may pause, relocate, or stop operation when rain, moisture, standing water, unsafe placement, unsafe access, or another electrical or safety hazard exists. The Client provides a suitable grounded power source within practical reach of the performance area and does not require BlackFist to share a circuit with known high-draw appliances when that would make operation unsafe. BlackFist makes the final on-site safety determination. A safety suspension does not itself waive amounts already owed under the separately accepted booking and payment terms.

Automatic Outdoor Weather Review

BlackFist automatically checks the saved event address and date, then rechecks upcoming outdoor and mixed events when they enter the available forecast window. The Client is not responsible for looking up or verifying the forecast. When the automatic forecast shows rain during or near the event day, the booking may require full estimated payment up front and a photo of the covered, dry equipment area. A missing shelter, unverified shelter, or unavailable indoor rain fallback requires owner review before BlackFist releases a payment link or confirms the event.

4. Equipment Custody, Restricted Devices, and Damage

This section applies only when the confirmed quote includes BlackFist equipment. The confirmed manifest, condition record, and available serial-number record are then part of the agreement. Required compatible signal and power cables are included support equipment, are not offered as standalone public hourly rentals, and remain individually or quantity-tracked on the private custody manifest. The Client accepts custody of listed equipment from delivery or handoff until BlackFist confirms return and post-event inspection. Only BlackFist or approved crew may handle, move, adjust, connect, or disconnect it. The Client may not sell, lend, sub-rent, pawn, relocate, alter, disconnect, or allow an unauthorized person to possess or operate it. BlackFist work devices, including any MacBook, iPad, or playback device, remain crew-only unless approved in writing. The Client is responsible for documented physical or liquid damage caused during Client custody, except to the extent caused by BlackFist negligence or willful misconduct. Venue Playlist + Engineer has no BlackFist equipment custody unless later added by a revised quote.

5. Theft, Loss, and Incident Response

This section applies only when BlackFist equipment is included. The Client must notify BlackFist immediately of theft, disappearance, attempted theft, loss, liquid exposure, or any security incident involving that equipment. For suspected theft or loss, the Client must promptly cooperate with a police or venue-security report, preserve available video and witness information, and provide the report number and venue contact details. The Client remains responsible for documented repair, replacement, recovery, shipping, and reasonable diagnostic costs caused by theft, loss, unauthorized transfer, or damage during Client custody, except to the extent caused by BlackFist negligence or willful misconduct.

6. Schedule Changes, Breaks, and Promotion

The confirmed service window is the schedule for the event. Additional time, changed scope, or a different venue requires BlackFist's written approval and may require a revised quote. Equipment may not be left unattended outdoors or moved without approval. During approved DJ Services, BlackFist may take one fifteen-minute operational break for each two hours of active performance. The Client may use the approved billing, "Lamontonthetrack" or "BlackFist Music and Cultural Productions", for event promotion. Approval is required before using BlackFist's likeness or logo. BlackFist may display discreet branding or tip/follow QR codes at the operating station.

7. Cancellation and Document Priority

Cancellation, retained down payment, refund-review, Priority Fee, return-credit, and payment timing are governed by the booking and payment authorization accepted for the specific quote. More than forty-eight hours before service, the standard retained amount is ten percent of the paid down payment. Within forty-eight hours, documented owner review may retain ten to fifty percent of the paid down payment. These terms do not authorize a new charge or alter a money term without later written authorization.

8. Equipment Security Deposit, Card Consent, and Damage Schedule

This section applies only when the confirmed quote includes BlackFist equipment. Each selected equipment tier then has its own stated refundable equipment security deposit. It is separate from the service invoice and is not credited to the final balance. After inspection, BlackFist will release the security deposit when equipment is returned in acceptable condition. For documented missing accessories, cosmetic damage, or excessive cleaning, BlackFist may charge only the itemized amount shown in the agreed fee schedule and release the remainder. Before a charge, the Client receives the itemized deduction and a private evidence link. Factory repair, liquid penetration, theft, total loss, or damage exceeding the security deposit is handled through documented owner review; the Client remains responsible for proven repair or replacement costs allowed by law. A Venue Playlist + Engineer plan carries no equipment security deposit. A stored card requires separate, optional consent that states the exact purpose and authorization; these terms do not authorize an undisclosed or automatic charge beyond an accepted authorization.

Standard fee schedule when equipment is included: IEC power cable $25; XLR/audio cable $40; wireless microphone or receiver $100; slipcover or column backpack $125; magnetic column spacer $150; minor scuffs $50; dented grill $150; deep gouge or cracked housing $200; excessive cleaning $50; sticky exterior liquid cleaning $75; smoke/vape residue cleaning $100. Documented repair labor is $30 per hour.

9. Electronic Records and Signature

The Client agrees to conduct the booking electronically, confirms the ability to open and retain electronic records, and consents to receive the completed agreement and transactional receipts at the submitted email address. By checking the required confirmations and typing the Client name, the Client adopts that typed name as an electronic signature for the event-specific agreement. BlackFist retains the agreement text, version, fingerprint, acceptance time, and verification evidence. The completed booking record is available by email after verified payment.

10. General

Connecticut law governs these terms. If one provision is unenforceable, the remaining provisions continue to the extent permitted by law. A change or waiver is valid only when confirmed in writing by BlackFist. Nothing in these terms waives rights or liabilities that cannot legally be waived.
